Why Service Matters
Your spouse has a constitutional right to notice of any legal action against them. "Service of process" is how you provide that notice legally.
Requirements:
- Your spouse must receive the divorce papers
- You cannot serve them yourself
- Service must follow your state's specific rules
- Proof of service must be filed with the court
Why proper service matters:
- Improper service can invalidate your entire divorce
- Your spouse can use improper service to delay proceedings
- The court won't proceed until service is properly completed
- Any orders issued without proper service may be voidable
Do not try to save money by cutting corners on service. Improper service can delay your divorce by months and cost you much more in the long run.
